operated by Form MD Aesthetics (“Form MD,” “we,” “us,” or “our”), and any features,
online scheduling, forms, text messaging, or other services made available through this
website (collectively, the “Site”).
By accessing or using the Site, submitting information through the Site, scheduling an
appointment, or otherwise engaging with us through the Site, you agree to be bound by
these Terms. We may update or modify the Site and these Terms at any time. Changes
will be effective when posted on the Site. Your continued use of the Site after changes
are posted constitutes acceptance of the updated Terms. If you do not agree, do not use
the Site.
- Medical Disclaimer; No Medical Advice; No Emergency Use
Content on the Site is provided for general informational and educational purposes only.
It is not medical advice and is not a substitute for evaluation, diagnosis, or treatment by
a qualified healthcare professional. Use of the Site, including submission of contact
forms, use of online scheduling, or receipt of general information, does not create a
provider–patient relationship. Any medical services require an in-person consultation,
appropriate medical evaluation, and informed consent.
Aesthetic and wellness outcomes vary by individual. Any testimonials, before-and-after
photos, or examples are not guarantees of results.
The Site is not intended for medical emergencies. If you think you have a medical
emergency, call 911 or go to the nearest emergency room. - Eligibility; Minors
The Site is intended for use by individuals who are at least 18 years old. If you are
under 18, you may not use the Site or submit information through it except with the
involvement and consent of a parent or legal guardian, and only to the extent permitted
by applicable law and our policies.
We operate in California and do not represent that the Site is appropriate or available
for use in other locations. - Intellectual Property; Site Content; Acceptable Use
The Site and all content and materials on the Site, including text, graphics, logos,
images, videos, audio, designs, interfaces, compilation, and software (collectively,
“Content”), are owned by or licensed to Form MD and are protected by U.S. and other
intellectual property laws. All intellectual property rights are reserved. We grant you a
limited, revocable, non-exclusive, non-transferable license to access and use the Site
for your personal, non-commercial use.
You may not copy, reproduce, modify, distribute, display, perform, publish, create
derivative works from, or otherwise exploit any Content without our prior written
consent, except as expressly permitted by law.
“Form MD Aesthetics” and our logos and service marks are trademarks of Form MD.
You may not use them without our prior written permission.
- User Submissions; Forms; Accuracy of Information
If you submit information through the Site (including scheduling requests, intake forms,
digital check-ins, contact forms, or messages), you represent that the information is
accurate, current, and complete. You retain ownership of information you submit, but
you grant us the right to use it as needed to respond to your inquiry, provide services,
and operate and improve the Site, subject to our Privacy practices and applicable law.
Unless expressly requested by us through a secure channel, do not submit highly
sensitive personal data through general Site forms (for example: Social Security
number, full payment card details, or detailed medical records). If you are unsure,
contact us using the Contact Information below. - Online Scheduling; Appointments; Cancellations; Late Arrivals
Use of online scheduling tools may constitute a request for an appointment. An
appointment is not final until confirmed by Form MD.
We may require advance notice to cancel or reschedule appointments and may charge
cancellation or no-show fees from time to time. Any applicable policies (including notice
windows and fees) will be disclosed at booking, in appointment confirmations or in our
office policies.
If you arrive late, your appointment may be shortened, rescheduled or canceled to avoid
impacting other patients.
We may decline, postpone, or discontinue a service if, in our clinical judgment, it is not
appropriate, safe or indicated. - Deposits, Payments, Packages, Promotions, and Refunds
Pricing, services, and availability are subject to change at any time without notice.
Certain services may require deposits or prepayment. Any deposit requirements,
whether deposits are refundable or credited, and any related conditions will be
communicated at booking or prior to treatment.
If you purchase service packages, memberships or bundles, additional terms may apply
(including expiration dates, transferability limits, and restrictions). Those additional
terms are incorporated into these Terms by reference.
Promotions and gift cards may be subject to additional terms, including expiration and
usage restrictions, as disclosed at purchase. Gift cards are subject to applicable
California law.
If you believe a charge is incorrect, contact us first so we can work to resolve the issue.
You agree not to initiate a chargeback for a charge you authorized, except in cases of
fraud or where otherwise permitted by law.
- SMS/Text Messaging and Messaging Consent
By providing your phone number and opting in through the Site, a form, or other opt-in
mechanism, you consent to receive SMS text messages from Form MD at the number
provided. Messages may include:
appointment confirmations, reminders, and scheduling updates;
follow-up communications related to your care or services;
customer service and support; and
occasional informational or promotional messages.
Message frequency may vary. Message and data rates may apply. You may opt out at
any time by replying STOP to any message. After you opt out, you may receive a final

Your consent to receive text messages is not a condition of purchase. - Email and Other Communications
By submitting your email address or otherwise contacting us, you agree that we may
communicate with you electronically, including for scheduling, service-related updates,
and administrative purposes. You can opt out of non-essential promotional emails by
using the unsubscribe link or by contacting us at info@formmd360.com. - Third-Party Services; Links
We may use third-party service providers and platforms (for example, scheduling
systems, CRM tools, payment processors, analytics providers, and messaging vendors)
to operate the Site and support our services.
Your use of third-party services may be subject to the third party’s separate terms and
privacy practices. We are not responsible for third-party platforms, including their
availability, security, performance, or policies.
The Site may contain links to third-party websites. We provide links for convenience
only and do not control or endorse those websites.
- Privacy; HIPAA Our collection and use of personal information through the Site are
described in our PRIVACY POLICY, which is incorporated by reference.
Uses and disclosures of protected health information (PHI) are governed by our Notice
of Privacy Practices and applicable law. Not all information submitted through the Site is
necessarily treated as PHI, especially if submitted through non-secure channels. - Disclaimers
The Site and Content are provided on an “as is” and “as available” basis. To the fullest
extent permitted by law, Form MD disclaims all warranties, whether express, implied, or
statutory, including implied warranties of merchantability, fitness for a particular purpose,
title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure,
or error-free, or that defects will be corrected.
IN NO EVENT WILL FORM MD BE LIABLE TO ANY PARTY FOR ANY DIRECT,
INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF
THIS WEBSITE, OR ON ANY OTHER HYPERLINKED WEBSITE, INCLUDING,
WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF
PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR
OTHERWISE, EVEN IF WE ARE EXPRESSLY ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES. - Limitation of Liability
To the fullest extent permitted by law, Form MD will not be liable for any indirect,
incidental, special, consequential, or punitive damages, or any loss of profits, revenue,
data, or goodwill, arising out of or related to your use of (or inability to use) the Site.
Form MD’s total liability for any claim arising out of or relating to the Site or these Terms
will not exceed the greater of (a) the amounts you paid to Form MD through the Site in
the three (3) months before the event giving rise to the claim, or (b) $100. Nothing in
these Terms limits liability that cannot be limited under applicable law. These Terms are
not intended to limit any rights you may have under California law with respect to in-
person medical services. - Indemnification
You agree to defend, indemnify, and hold harmless Form MD and its owners, clinicians,
employees, contractors, and agents from and against any claims, liabilities, damages,
judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees)
arising out of or relating to: (a) your violation of these Terms; (b) your misuse of the Site;
or (c) your violation of any law or the rights of a third party.
- Dispute Resolution; Governing Law; Venue
These Terms are governed by the laws of the State of California, without regard to
conflicts of laws principles. The parties agree that any action arising out of or relating to
these Terms or the Site will be brought exclusively in the state or federal courts located
in Orange County, California, and each party consents to personal jurisdiction in those
courts.
EXCEPT WHERE PROHIBITED BY LAW, THE PARTIES EXPRESSLY WAIVE TRIAL
BY JURY IN ANY JUDICIAL PROCEEDING INVOLVING ANY DISPUTE,
CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS. - Severability; Waiver; Assignment
If any provision of these Terms is held unlawful, void, or unenforceable, the remaining
provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision.
We may assign these Terms in connection with a merger, acquisition, reorganization, or
sale of assets. - Entire Agreement
These Terms, together with any policies or notices incorporated by reference (including
our Privacy Policy and any appointment/payment policies provided to you), constitute
